Acceptance of Terms

• By accessing or using Kaometrx, you agree to these Terms of Service. If you do not agree, do not use our services.
• If you are using Kaometrx on behalf of a restaurant or business, you represent that you have authority to bind that entity to these terms.

Services

• Kaometrx provides restaurant technology services including websites, digital ordering, analytics, and profit optimization tools. Features may vary by plan.
• We may modify, suspend, or discontinue any part of the platform at any time. We will make reasonable efforts to notify account holders of material changes.

Accounts & Responsibilities

• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• You agree to provide accurate information and to keep your account details up to date.
• You may not use Kaometrx for unlawful purposes, to transmit harmful content, or to interfere with the platform's operation or security.

Fees & Payment

• Paid plans are billed according to the pricing displayed at signup or in your agreement. Setup fees are due in full at checkout together with your monthly subscription. Fees are non-refundable unless otherwise stated.
• Failure to pay may result in suspension or termination of your account. You remain responsible for fees incurred prior to cancellation.

Your Content & Data

• You retain ownership of content you upload (menus, branding, order data, etc.). You grant Kaometrx a license to host, display, and process that content solely to provide our services.
• You are responsible for ensuring you have the rights to any content you submit and that it complies with applicable laws.

Intellectual Property

• Kaometrx and its logos, software, designs, and documentation are owned by Kaometrx and protected by intellectual property laws.
• You may not copy, modify, reverse engineer, or redistribute our platform except as expressly permitted in writing.

Disclaimer & Limitation of Liability

• Kaometrx is provided "as is" without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose.
• To the fullest extent permitted by law, Kaometrx shall not be liable for indirect, incidental, special, or consequential damages arising from your use of the platform.
• Our total liability for any claim shall not exceed the amount you paid Kaometrx in the twelve months preceding the claim.

Termination

• Either party may terminate the agreement according to your plan terms. You may cancel by contacting us or through your account settings where available.
• Upon termination, your right to access the platform ends. We may delete your data after a reasonable retention period, subject to legal requirements.

Governing Law

• These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
• Any disputes shall be resolved in the courts located in California, unless otherwise required by applicable law.
